Amongst CCF’s members, it is the managing directors who carry the highest level of risk of prosecution under the WHS Act. There is also evidence of Regulators around Australia starting to investigate non-executive directors who have no role in the day-to-day management of the business.

Once you have worked out who must comply with the officer due diligence duty, compliance is not hard. Join Harold Downes (Partner – Workplace Relations, Employment and Safety; Mills Oakley) to explore:

  1. the distinction between the duties of an “officer” and a “manager” – and how they should never meet;
  2. who is an “officer” for the purposes of WHS laws (including why it’s better for the C-suite to not be one);
  3. what indemnities and insurance are and are not available;
  4. the duty of due diligence imposed on officers under WHS laws; and
  5. practical guidance on how to discharge – and more importantly, demonstrate the discharge – of this duty.

This workshop is ideal for MDs, senior managers and H&S managers who support compliance.

It is important to note that this course will start at 7:30am sharp, so please aim to log on 15 minutes early. Those attending will receive a Microsoft Teams invitation (with instructions and a link) the day prior.
